Background
Since 2004, employers have been legally obliged under §167 Social Code IX to offer company integration management (BEM) to employees who have been ill for a longer period. Assistance is offered to employees who are unable to work continuously or repeatedly for more than 6 weeks within a year. In the event of repeated inability to work, the condition for initiating the BEM procedure may already be met after more than 30 days of absence due to illness within the last twelve months.
vysoft BEM supports you in identifying BEM cases and in carrying out a proper procedure. The aim of the BEM process is to maintain the job or overcome the inability to work. This is intended to ensure early intervention by the employer.
In the meantime, BEM has become particularly important in the event of a legal dispute before the labor court – for example in the event of dismissal. Employers who have not established a BEM process or have established an inadequate BEM process therefore run a substantial risk of losing a dismissal protection process.
